Bundle of Rights - Easement of Light!
My oh my, I attended yet another CRESAR (Comprehensive Real Estate Review) Seminar at Valle Verde Country Club. Yup! This going to be may third retake. I’m not ashame about it. Perhaps, my motto now is “Try and Try until you succeed!” - hahahaha!
Really, I wanted to pass the exam. So seriously, I’m practicing real estate math already - “Practice Makes Perfect” hehehe.
Okey, what about the bundle of rights - easement of light. Well, our speaker Atty Teddy Kalaw, the current president of PAREB - Rizal Board of Realtors talk about “Property Ownership”. And, he mentioned that as a property owner, one can exercise his bundle of rights - namely right to abuse, right to enjoy, right of easement and blah blah blah
So, what is easement? It’s your right as a property owner to enjoy your property fully. So, let’s say your property is sandwich between two properties facing the main highway. And, you have no other access to the highway but via either this two properties. Then, the law allow you the easement of way - make use of one of the two properties as your access to the highway - of course, this should be done with just compensation.
Now, with easement of light! hehehe One example, you are a condo owner with a nice view of Manila Bay’s sunset. Then, suddenly another high-rise condominium was developed that blocked your view of Manila Bay. As a property owner, you have your right (because you’re the first) for easment of light. You can demand, that the soon to be high-rise condominium can only be a floor lower that your condominium as not to block your view. Hehehe
